PURPOSE OF THE WEBSITE

On this website, I would like to clarify and protect my message and the legal framework.

• The meaning of music: Music is more to me than just music; it is like "music therapy," where at the end of the "therapy," a newly created piece of music waits for your ears. In the creative process of composing, it serves me to express emotions, melodies, harmonies... to process painful experiences and thus free my sensitive soul from pain again. So I share more than just my music; I share my soul's "medicine" with you, in the hope that it will also strengthen you, give you courage, strength, and cheerfulness.
• Free download and streaming services: Since 2015, I have made my music available for free download on radio.KUNIMUS.eu. Due to increased costs, I now only offer my works via streaming services. These platforms are intended to help cover at least my expenses - even if the actual revenue (sometimes only 10€ royalties a year) is unfortunately hardly enough for this.
• Legal protection of the music: My music is a central part of my life. My primary goal is to protect my works from any misuse. I strictly reject any association of my music with violence!
• Cooperation opportunities: I am open to creative cooperations. If you like my music and would like to realize remixes or similar projects, you are welcome to contact me in advance.
• Note for download mp3 fans of radio.KUNIMUS.eu: All .mp3 songs downloaded from Radio KUNIMUS in the past may continue to be used purely privately. These new legal terms replace all previous texts, but do not change the status of your old downloads. As a listener, you legally acquired these MP3 files directly from me, the sole composer and rights holder, at that time.

  The "COMPOSER GUIDE" is a non-commercial project by KUNIMUS ®. It connects young people with the musical past. Since nobody can search for artists whose names they don't know, I pass on my firsthand knowledge here. The guide provides the names of the true pioneers of electronic music, including direct YouTube links, to make their fundamental works immediately audible.

An image, a text, a video, a piece of music, anything created by a person or company.

COPYRIGHT AND ANCILLARY COPYRIGHTS

• The contents of the "online presence" are subject to German copyright and ancillary copyright law (intellectual property rights).
• All my works (music, video, image, text) are protected by copyright and can be found as a notarial deposit or in the Bitcoin-Blockchain serving as a technical proof of first publication (timestamp).
• Free download means that my works are available for 0€, but are never royalty-free.
• I create digital content (editorially with human creativity) using industry-standard software and occasionally use AI tools.
• I, Mario Baehnisch, will forever remain the sole creator and owner of all rights.
• Any commercial use mandatorily requires my prior written consent.

GEMA & GVL vs. DRMV

• All works created and offered by me, Mario Baehnisch (alias KUNIMUS ®, derKLANGmaster and derKLANG.eu), are completely free of GEMA and GVL rights.
• As music composer Mario Baehnisch, alias KUNIMUS ®, I am a registered member of the German Rock & Pop Musicians Association (DRMV, www.DRMV.de), since May 29, 1996, under membership number: 06932.
• derKLANGmaster has a GEMA tariff VR-Ö for playing copyrighted works in public, however, there is no personal GEMA / GVL membership as composer KUNIMUS.

• RADIO KUNIMUS ® is a private, non-commercial "Internet radio"
• RADIO KUNIMUS ® has no editorial content.
• RADIO KUNIMUS ® contents have no fixed broadcasting times.

• RADIO KUNIMUS ® is NOT subject to notification as an Internet radio station according to §20 b RStV [Note: Corresponds to today's State Media Treaty (MStV)].

• 100% Licensed Tools:
  Out of deep respect for the work of other developers, I exclusively use legally acquired and fully licensed software to create my works, and have done so for over 40 years. This conscious investment guarantees that all my materials are absolutely free of third-party rights and the exploitation rights remain entirely with me.
• I adapt third-party code under the MIT and GPL licenses and thank the developers for their excellent work.

IDENTITY PROTECTION (§ 12 BGB) &
REGISTERED TRADEMARK (KUNIMUS ®)

My name KUNIMUS is my identity

• In 2004, the term KUNIMUS had exactly 0 hits worldwide. I created my name "KUNIMUS" based on my three passions: ART (KUNST), INFORMATICS and MUSIC. My artist name "KUNIMUS" is my personal, worldwide unique identity. Furthermore, KUNIMUS ® has been registered as an official word mark to Mario Baehnisch at the German Patent and Trade Mark Office (DPMA) since 2004 ( KUNIMUS ® Class 35, 41, 42 and KUNIMUS ® Class 9, 16, 38).
• Strict prohibition of identity theft and name usurpation:
  Any unauthorized use of my name by third parties that suggests a false connection to my person or my works, or causes confusion of identity in public, is a clear identity theft according to § 12 BGB (German Civil Code - Right to a name) as well as a violation of my trademark rights. This will be prosecuted under civil and criminal law without exception.
  
  In particular, the following is strictly prohibited:
• Prohibition of fake profiles:
  It is prohibited to register my name KUNIMUS® (or intentionally modified spellings) as a profile, account, or artist name on platforms (e.g., TikTok, Instagram, Spotify, YouTube, etc.). Every unauthorized KUNIMUS account constitutes name usurpation.
• Misuse of search terms:
  It is prohibited to misuse my word mark in URLs, domain names, or specifically as a hashtag/meta tag in a way that creates the false impression that I support third-party content or created it myself.
• Protection of personal rights:
  It is strictly prohibited to associate my identity or trademark with religious, political, racist, sexist, violence-glorifying, or discriminatory content.
• Commercial prohibition:
  It is prohibited to make money directly or indirectly with my name KUNIMUS® or my works without authorization.
• Linking:
  Legitimate links to my original projects are welcome. Please preferably use the domain www.derKLANGmaster.de for this purpose.

NOTICE TO PLATFORM OPERATORS (EU DSA & LIABILITY)

• Note on the extensive scope of protection of my trademark and my identity protection (§ 12 BGB): Since KUNIMUS® has been explicitly protected since 2004 for (original wording of Nice Class 38): "...telecommunication services...", "...providing online forums..." and "...telecommunication via platforms and portals on the Internet...", any unauthorized account using my name (KUNIMUS) on platforms falls exactly into my protected trademark scope, independent of my IDENTITY PROTECTION (§ 12 BGB) as the owner Mario Baehnisch.
• My original accounts, managed by me (Mario Baehnisch), are transparently listed on this website under the SOCIAL menu. Only these accounts are legitimized.
• Loss of liability privilege in case of inaction:
  If fake profiles or channels using my name (KUNIMUS® or intentional variations such as "Kunimusik") and thus constituting a clear name usurpation (§ 12 BGB) are not deleted despite an official report (Notice-and-Action), the EU Digital Services Act (DSA) applies.
• In the event of continued inaction and toleration of identity theft, platform operators (such as TikTok, Spotify, etc.) lose their statutory liability privilege. • Die Bedeutung der Musik: Meine Musik ist für mich mehr als nur Musik, sie ist wie "Musiktherapie", wo am Ende der "Therapie" ein neu erschaffenes Musikstück auf eure Ohren wartet. Sie dient mir als Ausdruck von Emotionen, Melodien, Harmonien ... im Erschaffungsprozess des Komponierens schmerzhafte Erfahrungen von Erlebnissen zu verarbeiten und somit meine sensible Seele wieder vom Schmerz zu befreien. Ich teile also mehr als nur meine Musik, ich teile meine "Seelenmedizin" mit euch, in der Hoffnung, dass sie euch auch stärkt, Mut, Kraft und Frohsinn schenkt.
• Kostenfreier Download und Streaming-Dienste: Seit 2015 habe ich meine Musik zum kostenlosen Download auf radio.KUNIMUS.eu bereitgestellt. Aufgrund gestiegener Kosten biete ich meine Werke inzwischen nur noch über Streaming-Dienste an. Diese Plattformen sollen helfen, zumindest meine Unkosten zu decken - auch wenn die tatsächlichen Einnahmen (teilweise nur 10€ Tantiemen im Jahr) dafür leider kaum ausreichen.
• Rechtlicher Schutz der Musik: Meine Musik ist ein zentraler Bestandteil meines Lebens. Mein oberstes Ziel ist es, meine Werke vor jeglichem Missbrauch zu schützen. Ich lehne jede Verbindung meiner Musik mit Gewalt strikt ab!
• Kooperationsmöglichkeiten: Ich bin offen für kreative Kooperationen. Wenn euch meine Musik gefällt und ihr Remixe oder ähnliche Projekte umsetzen möchtet, könnt ihr mich gerne vorab kontaktieren.
• Hinweis für Fans, die früher MP3s heruntergeladen haben: Alle .mp3-Lieder, die in der Vergangenheit von Radio KUNIMUS heruntergeladen wurden, dürfen weiterhin rein privat genutzt werden. • In einigen alten Musikstücken (vor 2024) verwende ich "GEMA-freie", "Music-Samples" der Magix GmbH (mein alter Arbeitgeber) mit einer speziellen Lizenz.
• 100 % lizenzierte Werkzeuge:
  Aus tiefem Respekt vor der Arbeit anderer Entwickler nutze ich für die Erschaffung meiner Werke ausschließlich legal erworbene und voll lizenzierte Software und das seit über 40 Jahren. Diese bewusste Investition garantiert, dass alle meine Materialien absolut frei von Rechten Dritter sind und die Verwertungsrechte uneingeschränkt bei mir liegen.
• Ich adaptiere fremden Code im Rahmen der MIT- und GPL-Lizenzen und danke den Entwicklern für ihre hervorragende Arbeit.

IDENTITÄTSSCHUTZ (§ 12 BGB) &
EINGETRAGENE MARKE (KUNIMUS ®)

Mein Name KUNIMUS ist meine Identität

• Der Begriff KUNIMUS wies im Jahr 2004 weltweit exakt 0 Treffer auf. Ich habe meinen Namen "KUNIMUS" erschaffen, aus meinen drei Leidenschaften KUNST INFORMATIK und MUSIK. Mein Künstlername "KUNIMUS" ist meine persönliche, weltweit einmalige Identität. Zudem ist KUNIMUS ® seit 2004 als offizielle Wortmarke beim Deutschen Patent- und Markenamt (DPMA) auf Mario Baehnisch eingetragen (KUNIMUS ® Klasse 35, 41, 42 und KUNIMUS ® Klasse 9, 16, 38).
• Strenges Verbot von Identitätsdiebstahl und Namensanmaßung:
  Jede unautorisierte Nutzung meines Namens durch Dritte, die eine falsche Verbindung zu meiner Person oder meinen Werken suggeriert oder eine Zuordnungsverwirrung in der Öffentlichkeit auslöst, ist ein klarer Identitätsdiebstahl gemäß § 12 BGB (Namensrecht) sowie eine Verletzung meiner Markenrechte. Dies wird ausnahmslos zivil- und strafrechtlich verfolgt.
  
  Insbesondere ist Folgendes strengstens untersagt:
• Verbot von Fake-Profilen:
  Es ist verboten, meinen Namen KUNIMUS® (oder absichtlich abgewandelte Schreibweisen) als Profil-, Account- oder Künstlernamen auf Plattformen (z. B. TikTok, Instagram, Spotify, YouTube etc.) zu registrieren. Jeder unautorisierte KUNIMUS-Account stellt eine Namensanmaßung dar.
• Missbrauch von Suchbegriffen:
  Es ist verboten, meine Wortmarke in URLs, Domainnamen oder gezielt als Hashtag/Metatag so zu missbrauchen, dass der falsche Eindruck erweckt wird, ich würde fremde Inhalte unterstützen oder hätte sie selbst erschaffen.
• Schutz des Persönlichkeitsrechts:
  Es ist strengstens verboten, meine Identität oder Marke in Verbindung mit religiösen, politischen, rassistischen, sexistischen, gewaltverherrlichenden oder diskriminierenden Inhalten zu bringen.
• Kommerzielles Verbot:
  Es ist verboten, mit meinem Namen KUNIMUS® oder meinen Werken unautorisiert direkt oder indirekt Geld zu verdienen.
• Verlinkung:
  Legitime Verlinkungen auf meine Original-Projekte sind willkommen. Bitte nutzen Sie hierfür bevorzugt die Domain www.derKLANGmaster.de.

HINWEIS AN PLATTFORM-BETREIBER (EU-DSA & HAFTUNG)

• Hinweis zum großen Schutzumfang meiner Marke und meines Identitätsschutzes (§ 12 BGB): Da KUNIMUS® seit 2004 explizit geschützt ist für (Original-Wortlaut Nizza-Klasse 38): "...Telekommunikationsdienste...", "...Bereitstellung von Online-Foren..." und "...Telekommunikation mittels Plattformen und Portalen im Internet...", fällt jeder unautorisierte Account mit meinem Namen (KUNIMUS) auf Plattformen exakt in meinen geschützten Markenbereich, unabhängig von meinem IDENTITÄTSSCHUTZ (§ 12 BGB) als Inhaber Mario Baehnisch.
• Meine durch mich (Mario Baehnisch) geführten Original-Accounts sind auf dieser Web-Präsenz unter dem Menüpunkt SOCIAL transparent hinterlegt. Ausschließlich diese Accounts sind legitimiert.
• Verlust des Haftungsprivilegs bei Untätigkeit:
  Werden Fake-Profile oder Kanäle, die meinen Namen (KUNIMUS® oder absichtliche Abwandlungen wie z. B. "Kunimusik") nutzen und somit eine eindeutige Namensanmaßung (§ 12 BGB) darstellen, trotz offizieller Meldung (Notice-and-Action) nicht gelöscht, greift der EU Digital Services Act (DSA).
• Bei fortgesetzter Untätigkeit und Duldung von Identitätsdiebstahl verlieren Plattform-Betreiber (wie TikTok, Spotify etc.) ihr gesetzliches Haftungsprivileg. Ich behalte mir ausdrücklich vor, in diesen Fällen direkt gegen die Plattform-Betreiber auf Unterlassung und Schadensersatz zu klagen sowie eine offizielle Beschwerde beim zuständigen Digital Services Coordinator (DSC) der EU einzureichen.

FREMDE MARKEN

• Das Erscheinen von Marken oder Logos fremder Unternehmen auf meiner Internetpräsenz bedeutet nicht, dass ich Eigentümer dieser Marken bin. Die Rechte liegen bei den jeweiligen Unternehmen.

DATENSCHUTZ

VERBOT

• Werbeverbot: Die Kontaktdaten aus dem Impressum dürfen nicht für gewerbliche Werbung verwendet werden. Ich wünsche keinerlei Werbekontaktaufnahme (weder per E-Mail noch per Telefon).
